!LETTER: Jacksonville, Ark., Jan. 23, 1940. Dear Brother and family, Well I got your letter , in reguard to the deal on the home place, Arris and I have took care of Mother most of th e past year Mother was worring all the time wish she could get some one on the place tha t she could live with that would work and take care of the place, The place has run down t o where it will have to have a new barn almost a new fence, and a lot of repare on the house , Ruel Taylor (Auvella's Son.) agreed to take care of Mother the rest of her life and pay th e heirs $800.00 for the palce after her death, Well different men told me $800.00 was a goo d price for the place the way it was run down, and the way other farms were selling around th ere, Mother was staying with me when she found out that Ruel would take the place, well she w ould not let me rest till I go the deal started, we knew O.L. [Orlando Martin] would be har d to please so Ruel and I drove out to see O.L. and agreed on an option, we came home that ni ght got a lawyer to draw up the papers, Arris and I had signed them. I brought them down hom e for Mother to sign, then I mailed the papers to O.L. Ruel moved in the house and cleaned a nd fixed it up so he could keep Mother warm, then Mother went home happy as a Girl with a ne w doll. After 2 or 3 weeks they thought the papers ought to be coming back, 30 days afte r I sent the papers to O.L. Ruel wrote to O.L. about them, O.L. wrote back that had the pape rs and didnt like the way the papers were drawed up, of course if that was his excuse he coul d have sent the papers back and explaned what he wanted took out or what he wanted put in w e would have been glad to done so, but he still has the papers, he said he had rather lease t he place to Ruel, Well Ruel don't want to go there and put a lot of improvements on the palc e for the heirs to take at Mothers death, if the place was up in good shape that would be al l wright, it looks like Gus and O.L. thinks they can get a little more out the place at Mothe rs death by having Ruel there because he will have to do some improving to stay there, and a t the same time Ruel would be taking care of Mother. Ruel was down to see me yesterday sai d Mother was worring afraid she would have to leave the old home again, she told Ruel also to ld me some time ago that she would deed him a third interest in the place if he would stay th ere and take care of her, she can do that if she wants to, the law is, she can hold all the f arm till her death or she can divide the farm take one third and the heirs get two thirds o f course the heirs would not get as much but they would not have to waite till her death, the y would get there part now. Ruel told me if the other deal is off and I guess it is, he woul d take it that way if 4 or 5 of the heirs would sell there interest to him so ;he would hav e enough of the place to justify him to make a home there, then those heirs that want to kee p there part could do so, in the old deal he was to pay us $95.00 each taking out $5.00 to pa y some back to taxes that Mother says Gus was to pay but he refused to pay, so Ruel would hav e to pay the taxes to get a good title, Auvella said she would give him her part, Arris sai d he would sell his part I will sell him my part I think Zola will sell her part, I want it p ut in the deeds that he issto take care of Mother the rest of her life or the deed is not goo d, if we sell out right to him, of course he would have to take care of her to or he would no t get her one third interest, I am not a bit uneasy about him taking care of Mother, Ruel ha s a fine woman and two fine little girls they are going to school, if you would sell you par t to Ruel Write me or Ruel. From Ed.
