Osborn, an d with his and Jacob Rogers and John Martin who are persons of respectability and credit to t he court here well known, who being dully sworn at their oaths firm to the satisfaction of th e court that James Martin who was a private in Capt. Patrick company in the Regt. of Ark. Mtd . Vols. [Mexican war] that said Martin in his life time received for his service 160 acres . That on or about the 7th day of December 1850 [7th day of July] said James Martin departe d this life intestate, that the only heirs of law of said James Martin were Sarah Lynch, form erly Sarah Martin who intermarried with Joseph Lynch who resides in Illinois, Elizabeth Smit h who resides in the State of Alabama both of whom are sisters of decedent and his brothers E dmund T. Martin, William Martin, Solomon Martin and John Martin who reside in this State, an d that as the decedent left no wife child, or children, father or mother him surviving, sai d sisters and brothers are the only heirs at law of said James Martin deceased.

Eagan of Marion County and State of Illi nois Administrator of the goods and estate which were of Reece Eagan late of the said Count y, deceased intestate _____ greeting, Whereas at the April Term of the County Court of the sa id County of Marion State aforesaid in the year of our Lord one thousand eight hundred and si xty four in the matter of the petition of Henry H. Eagan administrator is aforesaid for lea ve to sell the following described real estate situated in Marion County and State of Illinoi s to wit: North half of the North East of Section (6) Six in Town Two (2) North of Range Thre e (3) East containing 75 Acres and Three quarters of an acre, it was ordered and decreed by s aid County Court setting in the words following to wit: on this day comes Henry H. Eagan Adm inistrator of Reece Eagan deceased and presents to the Court a petition praying for the sel l of the real estate described therein. The Court now leaves the cause and on motion of peti tioners solicitors doth appoint John W. notice of his intention to present his said petition to this term of the Court for the sale o f said real estate by publishing the same in the Salem Advocate a weekly newspaper publishe d in Salem in said County for three weeks successively the 1st insertion having been on the 2 5th day of February A.D. 1865 more than five weeks previous to the ___ ___ of this term it i s ordered and adjudged by the Court that the said Administrator have leave and be hurried t o sell the following described real estate situated in the said County of Marion and State o f Illinois to wit: The North half of the North East quarter of Section Six (6) Township Two ( 2) North of Range Three (3) East of third principal meridian containing seventy five (75) Acr es and three quarters of an acre, And it further ordered and adjudged by the Court that the s aid Administrator sell the said land on the sixth day of June next between the hours of ten o 'clock, A.M. and 5 o'clock, P.M. of said day on the premises the said Administrator having fi rst given notice of such intended sale recording to the requirements of the laws and that i n ____ the said Administrator should deem it best for the interest of said estate he may post pone the said sale to such other day as he may appoint always giving notice of such postpon e sale the same as in the first instance and it is further ordered that said lands be sold o n the following terms, one third cash in hand, and the balance is twelve months with interest , the purchaser to give a mortgage on the premises with approved personal security and that s aid Administrator report his acts and claims herein to this court, And that this applicatio n before that purpose continue and whereas in pursuance of said order and decree I ____ proce ed to sell the premises aforesaid after having given the notice aforesaid on the day and betw een the hours aforesaid at the place aforesaid at pubic vendue, and the said premises were au ction off to Joseph Lynch of Marion County he being the highest and best bidder therefor fo r the sum of Nine hundred and fifty five dollars, Now therefore know ye that I the said Hen ry H. This indenture made and entered into this the eleventh day of June in the year of our Lord o n thousand eight hundred and sixty from between Joseph Lynch and Sarah Lynch his wife of t he county of Marion and State of Illinois the parties of the first part and Henry H. Eaga n Administrator of Reece Eagan deceased of the county of Marion and State of Illinois the pa rty of the second part Witnesseth that the said parties of the first part for and in consider ation of the sum of six hundred and thirty five dollars and ____ cents in hand paid by the sa id party of the second part the receipt of which is hereby acknowledged do hereby grant, barg ain and sell unto the said party of the second part his heirs and assigns one certain tract f or and situate lying and being in the county of Marion and state of Illinois known, designate d and described as follows to wit, The North half of the North East quarter of Section Six (6 ) Town two (2) North of Range Three (3) East containing Seventy Five acres and Three quarter s of an acre, and for the consideration aforesaid the said parties of the first part thereb y name and release confirm and transfer, and forever relinquish to the said party of the seco nd part all right interest or title they may now have or may hereafter acquire in and to sai d real estate here in before described by virtue of the Laws of the State of Illinois approve d February 11th A D 1851, entitled “An Act to exempt homestead from sale on execution” And al l laws given _____ thereof To have and to hold the aforesaid tract or parcel of land free fr om all homestead exemption rights together with all the appurtenances thereunto belonging o r in anywise appertaining to the only proper use and benefit of the said party of the secon d part his heirs and assigns forever. And the same parties of the first part for themselve s heirs executors and administrators do covenant with the said party of the second part tha t they are lawfully sized that the said land is free from all incumbrance that they have ful l right to convey and will forever Warrant and defend the said tract of land from the claim o f them the said parties of the first part their heirs and assigns and against the claim of cl aims of any other person whomsoever nevertheless the above indenture of mortgage ______ ___ _ ___ ___ only condition that whereas

the said Joseph Lynch and one Samuel P. Wilson are indebted to the said party of the secon d part Administrator as aforesaid in the sum of $635.00 as appears by a curtain promissory no te of even date herewith and payable twelve months after date with interest at the rate of te n per cent per annum Now if the said parties of the first part shall pay said note and inter est when due then this mortgage shall cease. But if the said parties of the first part shal l fail to pay said sum of money to the said party of the second part according to the tenor a nd effect of the said promissory note and shall also by themselves cause the pay all cost o f collection of said sum of money to pay all attorney’s fees for the collection of said sum o f money and from the time said promissory note becomes due according to the time, tenor an d effect whereof and also as liquidated damages the additional sum of ten per cent per annu m Then these presents to be in full force and virtue for all the purposes herein before expr essed.
