This day personally appeared before the clerk of the circuit court for said County and Stat e aforesaid, Edmund T. Martin, who applies for letters of administration upon the estate o f his brother James M. Martin, who after being duly sworn deposes and says to the best of hi s knowledge and belief the value of said estate is about the sum of four hundred dollars; tha t the deceased died without a will, that the names and places of residence of the heirs of sa id deceased are as follows to wit: William Martin who resides in the State of Alabama, Sara h Lynch who resides in the State of Illinois, Elizabeth Smith, Edmund T. Martin, Solomo n P. Martin and John M. Martin, all residing in the state of Arkansas, that he will well an d truly administer all and singular the goods and chattels rights and credits of the deceased ; pay his debts as far as his assets will extend and that he will account for and pay over ac cording to law all assets which shall come to his hand a possession.

MOTHER’S DECLARATION FOR ARMY PENSION.

On this 3d day of March A.D. 1866, before me, Clerk of the Circuit Court for the County of Jo hnson and State of Arkansas personally appeared Mrs. Elisabeth Smith, aged 49 years, a resi dent of Johnson County in the State of Arkansas who, being duly sworn according to law, dot h on her oath make the following declaration: That she is the widow of Abraham Smith and mot her of Edmond S. Smith, who was a Private in Company “A” commanded By Captain Ira D. Brons on in the 4th Regiment of Arkansas Infantry Volunteers, and who die’d at Fort Smith Arkansa s on or about the Eight day of June 1866, by reason of Typhoid Fever, he die’d in General Hos pital at said Fort Smith of said disease contracted while a Soldier as aforesaid in the lin e of duty. She further declares, that her said son, upon whom she was wholly dependant for s upport, having left no widow or minor child under sixteen years of age surviving, declarant m akes this application for a pension, under the act of Congress approved July 14, 1862, and re fers to the evidence filed herewith, and that in the proper department to establish her claim . She also declares that she has not in any way been engaged in, or aided or abetted the reb ellion in the United States, that she is not in receipt of a pension under the second sectio n of the act above mentioned, or under any other act, and that she has not married since th e death of her son the soldier above named. She hereby constitutes and appoints Rep Daniel s & Sherwood her attorneys with power of substitution to prosecute the claim and procure a ce rtificate, with full power and authority to do and perform all and every lawful act and thin g whatsoever necessary and requisite to be done in and about the premises, except drawing th e money, which will be hereafter provided for my post office address is Clarksville in th e County of Johnson and State of Arkansas.

Grides residents of Johnson County, A rkansas persons whom I certify to be respectable and entitled to credit, who being duly swor n according to law, declare that they are personally acquainted with Mrs. Elizabeth Smith w ho has made and subscribed the foregoing declaration in their presence, and were personally a cquainted with her and her son before he entered the military service of the United States . That her son, the said Edmond S. Smith was the person who served as stated in said declar ation. That from their knowledge of, and acquaintance with the family of the declarant and h er son, the soldier above named, they know that he left surviving no widow, or child, or chil dren under sixteen years of age; that she was wholly dependent upon him for support, and tha t she was the wife and is now the Widow of Abraham Smith and has been a widow since the deat h of her said son. That they reside as above stated and have no interest in the prosecutio n of this claim. We were members of said Co. “A” we know that he enlisted in said company a s stated above and I William Bristow being O.S. of said company knew the Surgeon of the Hos pital reported to the company that he died as above stated, that said disease was contracte d while in the line of duty as a soldier as aforesaid } William Bristow

A, 4th Reg’t , Arkansas Infantry Vols., personally came before me, a clerk of the Circuit Court, in and fo r the aforesaid County and State, Micheal M. Bean, who I hereby is a respectable and credib le person, and who, being duly sworn, declares in relation to the aforesaid claim that his ag e is 58 years, and he has been intimately acquainted with the above - named claimant since 18 48, and knew her son, the above - named soldier for 16 years immediately prior to his enlistm ent in the military service of the United States. That said Elizabeth Smith has owned no re al estate since enlistment of her said son Edmond S. the husband and father having died befo re sons enlistment - at the time of enlistment of said Edmond S. the said Elizabeth owned o nly two cows and calves about six head of hogs a small lot of household property the whole va lue of which was not more than one hundred dollars - the claimants income from all sources si nce her sons enlistment has been nothing ______ as _____ only given to her by friends - She h as received a living since Sons death through _______ of friends and her own labor which ha s been ______ very little on account of her age The husband and father having died previou s to sons enlistment and left nothing for support of his widow and son. That he has been wel l acquainted with said Elizabeth since 1848 Knew her said son Edmond S. from his birth t o his death, Knew him to be a _________ ________ 4th Arks Infty. Knew that at the time of hi s enlistment he was living with his _____ mother Elizabeth and that he was her only dependan ce for support she not being able to support herself. He further declares that his post offi ce address is Clarksville, County of Johnson, State of Arkansas, and that he is not intereste d in said claim or concerned in its prosecution: that his knowledge of the foregoing facts wa s derived from an intimate acquaintance to said parties since 1848 living neighbors to them.

For Use In Mother’s or Father’s Pension Claim.

In the matter of the Pension Claim of Elisabeth Smith mother of Edmond S. Smith, Co. A, Reg ’t Arks., Vols., personally came before me County Clerk, in and for the aforesaid County an d State, A.J. Watts, who I hereby certify is a respectable and credible person, and who, be ing duly sworn, declares in relation to the aforesaid claim that his age is 44 years, and h e has been intimately acquainted with the above-named claimant since 1852, and knew her son t he above named soldier for 12 years immediately prior to his enlistment in the military servi ce of the United States.
That he had never been married, his mother the claimant was a widow at the time of his birt h his father having died prior thereto. In the year 1861 all the sons of claimant had left h ome, except this one who remained with his mother and was her sole dependent for support unti l he enlisted in 1864, and died shortly thereafter. He contributed to his mothers support b y performing all the labor on their little farm under her direction, being her sole and onl y dependence for that business, and after his enlistment he died before he drew any pay upo n which his said mother was relying for support, after his said enlistment. He further decla res that his post office address is Cotton Wood Cherokee Nation, Ind[ian] Ter[ritory], and th at he is not interested in said claim or concerned in its prosecution; that his knowledge o f the foregoing facts was derived from his living in the immediate neighbor home of the claim ant during his acquaintance with her. In the matter of the Pension Claim of Elizabeth Smith, mother of Edmund S. Smith, late of Co . A. Reg’t 4 Ark, Infantry Vols., personally came before me, Circuit Clerk, in and for the af oresaid County and State, Elizabeth Smith, who, being duly sworn, declares that she is the c laimant in the above-described claim, and her Post office address is Excelsior, County of Seb astian State of Arkansas; that My residence and P.O. address at the time of my son’s death wa s Clarksville Johnson Co. Ark. I lived at Clarksville until the year 1870 when I moved to Seb astian Co. Ark making Greenwood my P.O. until four or five years ago when my present P.O. wa s established (Excelsior) At the time of the soldiers death I was a widow. I had three child ren living: Thomas M. Smith aged 28 years Sarah Catherine Bates aged about 26 years, an d Zelphia Hale age about 22 years. This was all the members of my family at that time. I ha ve supported myself ever since the soldiers death without any legal support or help.

A PIONEER FAMILY

Mr. John Been was born in the year 1859 in Clarksville, Arkansas. His parents died while h e was a very young boy. His grandmother, Mrs. Elizabeth Smith assumed the responsibility of c aring for John and his sisters, Mary Tennessee, Jane and Vicy Catherine. Other foster childre n of Elizabeth Smith were James, Sterling and Rob Bates, Monroe, Edd, Jesse and May Long . They all lived as brothers and sisters on the place now owned by Ray Cahoon which was deede d to Elizabeth Smith by Robert Bates, uncle of Sterling, Rob and James Bates. They were al l well cared for, taught and trained by Elizabeth Smith who they lovingly referred to as Gr anny Smith. Mr. Beens wife, Margaret [Talbott] Been was born in Waldron, Arkansas in the yea r 1860. At age 9, she assumed the responsibility of keeping house and caring for her mother w ho was an invalid for many years. Mr. and Mrs. Been were married 4 March 1887. At first the y farmed near the old Stump Springs on Backbone Mountain. Later, they bought an 80 acre far m which joined the farm where he had lived with Granny Smith and the other nine of Grannie ’s foster children. They built a pioneer log cabin on their 80 acres which had five acres cl eared. They moved in before the fireplace was finished and Mrs. Been did the cooking campfir e style for 2 months. The Beens reared a large happy family. They all worked hard but took t ime out for recreation and rest. Mr. Been always rested or napped for 30 minutes after his no on meal. Mr. and Mrs. Been are remembered for their generosity and hospitality; especially t heir summer banquets of fruit and water melon. They both had delightful hobbies. He was a bee keeper and his hobby brought him a nice income along with pleasure. Another hobby was raisin g decorative dipper gourds. He made children happy by telling stories of the past. Mrs Been s hobby was making beautiful quilts. They both liked to visit their many friends and were goo d listeners and helped solve many problems and helped bear their many burdens. In their lat e life they made trips by train to places of interest in the United States. On their 50th we dding anniversary they had an all day celebration. Mr. and Mrs. Swift, teachers at nearby Ne w Hope School were asked to bring the school children. Mrs. Swift planned and appropriate pro gram for the children to give. The event of their 70th anniversary was known far and wide. T hey were married 72 years when Mr. Been died at the age of 91. Mrs. Been died 1 June 1955, ag e 96. At Mr. Beens death he was referred to as a “Man of God”, like Abraham of old. Mrs. Bee n was referred to as a virtuous woman. They were members of the Valley View Church of Chris t and their remains rest in the Valley View Cemetery near their old home in South Sebastian C ounty. Children of Mr. and Mrs. Been include, Joel, Edd, Perry, Lizzajane (all deceased ), Ben of Greenwood, Luther of Fort Smith, Jesse Waco, Texas, John Junior Indiana, Effi e Huff Rosswell, New Mexico, Mrs. Ninnevell Ulmer Greenwood, Arkansas, Mrs. Velma Gofort h Hackett, Arkansas.
