!LEGAL DISPUTE:On the 1st day of October 1860, Wilson Lype, John Lype, Samuel Keneday & wif e Barbara, - James Elliott, spelled, "Ellestto" & wife Elizabeth, Reuben and Moses Lipe of He nderson County, Tennessee file a legal disput against John Martin & wife "Lavenia", Charley B uck & wife Lydia, Thomas Ruddle & wife "Catharine" and Margaret Lipe over a slave and land ow ned by Henry Lipe - deceased. Jessie (Ruddle) Moore McCamon of Wichita, Kansas states, "Thi s legal proceeding was regarding selling 422 1/2 acres in District 13 of Henderson County, Te nnessee which is the southern most part of the county. This is information that disproves th at John Miller Martin was Catherine Ruddle's brother. He John Miller Martin was her brother- in-law." In this case it appearing that in pursuance of an interlocutory decree heretofore made the cl erk of the court gave the notice therein required and then on the 15th of Dec. 1860 on the pr emises of the late Henry Lipe deceased, Sold the land undivided half of the negro mentioned i n the pleadings and said degree on term & condition therein specified and that notes and secu rities were taken for the purchase money and that they are good all of which appears by the r eport of the clerk filed at the present term to which there is no exception taken and therefo re in all things confirmed and the case continued for further orders when the purchase mone y shall be paid.

In this case the undersigned clerk and master of the county court of Henderson County Tenn. a nd special commissioner for the Sale of the land and undivided interest in and to the slave H arriet mentioned in the pleadings in this cause reports that the purchase money for the sam e has all been paid as follows "to wit." Amt. Land sold for $2000.00. Int. Rec'd on same $2o .oo. Amt. Slaves sold for 475.00. Int. Rec'd on same 4.75. Total amt. collected $2495.75.

It is therefore ordered adjudged an d decreed by the court that all the right title and interest that Wilson Lipe, Samuel Keneda y & wife Barbara, Jame Elliott and wife Elizabeth, Reuben Lipe, Moses Lipe, John Martin and w ife Lavenia, Charles Buck & wife Lydia, Thomas Ruddell and wife Catharine have in and to th e following described tract of land to wit lying and being in the county of Henderson and dis trict no 13 containing by estimation 422 1/2 acres be the same more or less and bounded as fo llows: Beginning on a sassafras white oak & black oak the south east corner of Reserve Entr y no 500 for 92 acres in the name of James Austin and runs south with the west line of entr y no 459 for 1000 acres in all south 300 poles to an ash & hickory thence west 204 poles t o a small sassafras & small white oak thence north 148 poles to a stake dogwood & willow then ce with an agreed line at abot 650 north of East 58 poles to a hickory rod oak & __ thence wi th said line at about 550 north of west 68 poles to a hickory black oak & white oak thence we st 54 poles to a hickory 7 white oak thence north 93 poles to a dogwood hickory & black oak t hence east 148 poles to an elm thence south 34 poles to a stake white oak and 2 black oaks th ence east 114 poles to the beginning be and the same is hereby divested out of them and veste d in John Lipe the purchaser, his heirs and assigns forever. And it is further ordered adjud ged and decreed by the court that al the right title and interest that Wilson Lipe, John Lipe , Samuel Keneday and wife Barbara, James Elliott & wife Elizabeth, Moses Lipe, John Martin an d wife Lavenia, Charles Buck & wife Lydia, Thomas Ruddell & wife Catharine and Margaret Lip e have in and to the girl Harriet be and the same is hereby divested out of them and vested i n Reuben Lipe the purchaser, his heirs and assigns forever. It is further ordered and decree d by the court that the clerk and master of this court retain all the cost and attorneys fe e in this case, and pay over the balance of the aforesaid purchase money to the several heir s and distributees of Henry Lipe dec'd as they may be lawfully entitled to the same all of wh ich is finally ordered adjudged and decreed.
