Received & Filed in District Court Pitt sburg County, Oklahoma Dec. 10, 1925. IN THE DISTRICT COURT IN AND FOR PITTSBURG COUNTY. Stat e Of Oklahoma, Vallie Weatherford Plaintiff vs. No. 9138, Ed Weatherford Defendant.[...] Tha t said plaintiff and said defendant were legally married at Indianola, Oklahoma, on the 21s t day of December, 1919, and have ever since been husband and wife. That of said marriage tw o children have been born whose names and ages are as follows: Edith Weatherford, aged five a nd Lucille Weatherford, aged three. That the said Edith Weatherford is now the adopted daugh ter of R.H. McCaleb, of Harlingen, Texas. Plaintiff alleges that within two or three month s after the date of the marriage of Plaintiff and defendant, that defendant began course or c ruel treatment towards the plaintiff in this to-witt: that he continually cursed and abused t he plaintiff, calling her vile and opprobrious names both in public and in private to her gre at mental humiliation and pain; that within a year after the marriage of said plaintiff and d efendant said defendant struck and beat the plaintiff and that the conduct on the part of th e defendant continued during the entire time that they lived together as husband and wife unt il the conduct of defendant became unbearable and plaintiff was finally compelled to leave th e defendant which she did in the month of April, 1924, since which time she and defendant ha d not lived together. Plaintiff further alleges that defendant drank continuously and was dr unk a great part of the time that she lived with him. Plainfill further alleges that thoug h the defendant was strong and ablebodied man that he failed, neglected and refused to suppor t plaintiff and their children and that she was compelled to procure support from her mother ; plaintiff further alleges that since the date of their separation that defendant has not co ntributed anything to the support of herself and children, but that just recently she has rec eived a letter from defendant refusing to contribute anything to her and her children's suppo rt but told her in said letter that he was spending his money on one that he loved. DIVORCE D ECREE, [...] 6th day of February, 1926 [...] And the Court finds that the plaintiff is withou t fault, and that by reason of the acts of the defendant and the fault of the defendant, plai ntiff is entitled to a decree of divorce as prayed for. It is therefore ordered, adjudged an d decreed by this court, that the marriage relation heretofore existing between the said Vall ie Weatherford and the said Ed Weatherford, be, and the same is hereby dissolved, and both pa rties are released from the same. It is further ordered that the care, custody and educatio n of the child of the parties hereto, Lucille Weatherford, be confided to the plaintiff exclu sively, and the defendant is hereby enjoined from interfering with said child, or with the pl aintiff in her custody of said child, except that he may visit said child at reasonable time s while said child is in the custody of the plaintiff herein and until the further order of t he court. !FUNERAL: TWO KILLED IN ACCIDENT EARLY THURSDAY NIGHT, Ed P. Tingle of Roff and Mrs. Vallia S ublett of Savannah Victims, CRUSHED IN TRUCK CAB, Companions Unhurt When Steering Gear Fails , Car Overturns. Tragedy struck suddenly Thursday night at four people who were coming to Ad a from Roff, and snatched the lives of two when the light truck in which they were riding ove rturned. Edward P. Tingle, 58, of Roff and Mrs. Vallia Sublet, 28, living near Savannah, wer e killed instantly. A niece of Mrs. Sublett Mrs. Dillard Stewart, and Mr. Stewart were uninju red. According to Stewart, who was driving the truck, the steering gear failed him while o n a turn about 9 o'clock Thursday night, and the truck, out of control, ran off the embankmen t, turned over and pinning the occupants in the cab. People coming along the highway pulled t he truck from the occupants, and Mrs. Sublett and Mr. Tingle were brought to Ada, where it wa s found that they had been killed. Probably instantly. Mrs. Sublett's left chest and shoulde r were crushed internally. Mrs. Sublett had been visiting in Roff with her niece and Mr. Ste wart for two days. They are reported to have been coming to Ada to see a show and were in Mr . Tingle's truck. He was manager of a filling station. Funeral services for Mr. Tingle wil l be held Saturday afternoon at 3 o'clock at the Baptist church in Roff. Rev. Holland officia ting. Burial will be in East Hill Cemetery. Roff. Criswell Funeral Home of Ada in charge. Mr . Tingle is survived by his widow; two daughters, Mrs. Hattle May Bentley, Stuart, and Miss G ladys Tingle, Sulphur; and two sons, Evan Thomas Tingle and Edward Paul Tingle of Roff. Servi ces for Mrs. Sublett are under direction of the Chaney Funeral Home of McAlester, which toda y took her body form Ada to McAlester. Postal Dated Tuls a OK PM 13 Mar 2001. Letter reads as follows: 3-14-2001, Dear Mr. Thomas, I was so surprise d to hear from you, I've had to think about answering. Seems to me you know more about my fa mily than I ever did. I was living with my Grandma Stubblefield as my first memory & of cour se my Great Grand Mother Mary E. Smith. I was only 10 when I rember the 1st death in our fam ily which was Will Smith. My Grandmother brother & then I was 12 when my mother Vallie Suble tt was killed in a car wreck near Ada, OK. She was running away from Sublett & had went to h er ex husbands sister to get away. She was not related to any one there. - Ada, OK. I live d with my Grand Mother till I was nearly 17 yrs at which time I married & had 3 sons. I marr ied Nick Mosco at that time of my life, we were married 57 yrs. I lost him Dec. 22-96. By t hat time I'd lost my family on my mothers side of the family & also a lot of memories. Somet imes I wish I had paid more attention to things I was told. But I'll be 79 yrs. old in Jul y so its a little late. I never dreamed of ever coming back to Henryetta but my husbands nei ces & nephews & their familys live here. My husband & his family worked the coal mines. I m et a surprise relative recently they're also moving back here. I havent really got to visi t with them yet but I'll let them read your letter. The man is Uncle Will Smith's grandson . He was the son of "Ode" Smith. I barely remember her. I remember Ada & George Malone sh e was Uncle Will's daughter too. My Grand Mother & her sister kept in touch with them fo r a long time but they'd both be dead by now & they dident have children. My sister is als o deceased she married Jake O. Davis of Houston. She had a daughter & son but they know les s about the family than I did. As far as Ettie Lick Cathey she lived in California for all m y life so I never knew her or her family. I remember she had two son's Jack & Ferron. She m arried Teck Cathey from Indianola, OK. I don't know much else only there is still Cathey i n Indianola but the few I'd met & talked too was old, 20 years ago. I can tell you very litt le about my Great Grandmother only I loved her very much. She used to tell me stories abou t the Civil war, of which I can recall very little. I know she received a veterans check fro m that war - Civil - she took care of the whole family the best I remember. I know she live d to 96 yrs & was blind & deaf. She could hear, but you had to yell & she was well taken car e of & kept at home all her final years. I never remember hearing anything about Orego n - I remember she kept me from spankings. All I had to do was yell long enough & she'd mak e them (Mother & Grandma) let me alone. Thats my best memory. Well after you try to read al l this you may be sorry you wrote. Its been interesting but at my age I don't remember a lot . I'm planning on a couple of trips this spring & summer. I'v just got to take my first ai r plane trips these last few years & love it. I have a wonderful neighbor - shes a widow to o & a little younger so we go shopping & church together. Her family has adopted me & my fam ily (older generation) is really getting small. Hope you can at least read some of this.
