Westville, I.T. July 18, 1900
In the matter of the application of John Whisenhunt et als., for enrollment as Cherokee citi
zens, said Whisenhunt being sworn by Commissioner Needles, testified as follows:
Q What is your age? A 39.
Q Your post office? A Westville.
Q Where did you live? A Four miles northwest of Westville.
Q How long have you lived there? A Six years.
Q Where did you live before that? A About two miles east of Westville.
Q How long have you been living in the Cherokee Nation? A I guess I have been living here som
ething near 28 years or 29 years.
Q Continuously? A Yes.
Q Never had a residence outside during that time? A No sir.
Q What is the name of your father? A Ben Whisenhunt.
Q Is he living? A yes.
Q Are you upon the Cherokee rolls? A No sir.
Q What is your mother’s name? A I don't know; she died when I was small.
Q Does your name appear upon the roll of ‘80? A No sir, I was not admitted until '84. On '9
6 roll, page 830, number 206.
Q Did you ever apply to the tribal authorities of the Cherokee Nation for citizenship? A No s
ir.
Q Did you ever apply to the Dawes Commission before for citizenship? A No sir.
Q Are you married? A Yes.
Q What is your wife’s name? A Brunett.
Q What was her name before she married you? A Brunett Weaver.
Q Is she on the roll of ‘80? A Yes. On ‘80 roll, page 485, number 1854; On ‘96 roll, page 803
, number 2293 as Brunett Whisenhunt.
Q You say you were married in ‘84? A Yes.
Q Have you any certificate of marriage? A No sir.
Q Under what law-were you married? A Cherokee law.
Q Where? A On Ballard creek.
Q Who married you? A Nathan West.
Q Have you any certificate at home? A No sir.
Q You got a license, didn’t you? A Yes.
Q You can get a certified copy of that license? A We lost the license. I have two witnesses h
ere to prove my marriage.
MARY WEAVER, being sworn, testified:
Q What is your name? A Mary Weaver.
Q How old are you? A I expect I am up in the 60s.
Q Are you a Cherokee citizen? A No sir, I am an adopted citizen.
Q You live in the Cherokee Nation? A Yes, been in it ever since I was born mighty near.
Q Do you know John Whisenhunt? A Yes.
Q Do you know his wife Brunett? A Yes.
Q Do you know whether they are married or not? A Yes.
Q How do you know? A I saw them married - she is my daughter and they were married in my hous
e.
Q Were they married under Cherokee law? A They were married by a licensed preacher.
Q Have they been living together as man and wife ever since? A Yes, and are now.
JOHN WEAVER, being sworn, testified:
Q What is your name? A John Weaver
Q How old? A 35.
Q Where do you live? A 5 miles west of here.
Q What is your postoffice? A Westville.
Q Are you a Cherokee Citizen? A Yes.
Q By blood or adoption? A By blood.
Q Do you know John Whisenhunt? A Yes.
Q Do you know his wife, Brunett? A Yes.
Q Do you know whether they are married or not? A Yes, I saw them married.
Q Do you know whether they were married by Cherokee law or U.S. law? A They were married b
y a licensed preacher.
Q Do you know whether John Whisenhunt had any license? A I don't know.
Q You know they are living together as man and wife? A Yes.

The name of John Whisenhunt appears upon the roll of ‘96 and proof shows that he was marrie
d to Burnett Weaver in ‘84. He will be enrolled as an intermarried citizen. His wife, Br
unett Weaver, is found upon the roll of ‘80 and also ‘96, proof being made of residence an
d she and her 8 children will be enrolled as Cherokee citizens on the roll now being made
. James and Pearl compiled, their enrollment will be completed when the proper certificat
e of their birth is furnished to the Commission, and the enrollment of John Whisenhunt himse
lf will not be completed until he furnished this commission a certified copy of his marriag
e license.
Brown McDonald, being sworn by Commissioner Needles, says that as Stenographer to the Comm
ission To The Five Civilized Tribes, he reported in full the testimony of the above named thr
ee witnesses, and the foregoing is a full, true and correct transcript of his notes. B

In the matter of the application of John Whisenhunt for the enrollment of himself as a citi
zen by intermarriage and for the enrollment of his wife, Brunett Whisenhunt, and his child
ren, William, Benjamin, Mary, Josie, Joseph, John L., James, Pearl P. and Annie B. W
hisenhunt, as citizens by blood of the Cherokee Nation. CHEROKEE #350.
John Whisenhunt, being duly sworn, testified as follows: Examination by the Commission.
Q. State your name? A. John Whisenhunt.
Q. How old are you? A. 42.
Q. What is your post office? A. My post office is Westville, I.T.
Q. Are you a white man? A. Yes, sir.
Q. Are you claiming the right to be enrolled as a Cherokee citizen by intermarriage? A. Why
, that has always been--never been nothing against me.
Q. What is your wife’s name? A. Brunett Whisenhunt.
Q. Is she the wife through whom you claim citizenship? A. Yes, sir.
Q. When were you married to her? A. '84.
Q. Were you married under a Cherokee marriage license? A. I think we was; yes, sir.
Q. Did you present your marriage license and certificate when you applied for enrollment? A
. No, sir.
Q. Have you got them? A. They were destroyed.
Q. How did they get destroyed? A. I couldn't hardly tell you. They was in an old trunk we ha
d and when the Dawes Commission came we couldn’t find them and we never have found them.
Q. Who married you? A. A man by the name of West.
Q. Was he a preacher? A. Yes, sir.
Q. What district? A. Goingsnake.
Q. Did you have a petition. A. Yes, sir.
Q. Paid your $10 did you? A. Yes, sir.
Q. Took the oath? A. Yes, sir.
Q. How soon after that was it that you were married--after you got the license? A. Oh, it wa
s probably two or three days.
Q. Did the preacher give you a marriage certificate? A. No.
Q. What did he do with the license? A. He handed that back to me.
Q. What did you do with it? A. I just put them away.
Q. Did you ever send them to be recorded? A. No, sir; I just put them away.
Q. You just put them in the trunk? A. Yes, sir.
Q. You never sent them to the clerk to be recorded? A. No.
Q. Is this man Gormally living? A. No, Gormally is dead, He has been dead a good while.
I don't know just how long he has been dead.
Q. Your marriage wouldn't be a matter of record then if you never sent your license to be rec
orded. You are sure the preacher gave them back to you? A. Yes, sir.
Q. What was the preacher’s name? A. West.
Q. What was his first name? A. I forget his first name now. Q. Is he living now? A. No, he i
s dead. Nathan– Nathan West was his name.
Q. He is dead also? A. Yes, sir, that is my understanding.
Q. Who was present at your marriage? A. Why, there was some three or four. John Weaver wa
s one, Joe Weaver and the old lady Weaver.
Q. What was her first name? A. Mary Weaver. I don't remember now who was present outside th
e family.
Q. Any of these witnesses living? A. Yes, sir; two living that I know of.
Q. Which two? A. Joe Weaver and John.
Q. Where are they living? A. They are living in Goingsnake. Old man Weaver is in Sequoyah di
strict.
Q. Who is old man Weaver? A. He is the father of John Weaver. John Weaver is a half broth
er of my woman.
Q. Are they living? A. Yes, sir.
Q. Did they see your marriage license? A. I guess they did. Q. Do you know that they ever did
? A. I wouldn't swear positively that they did but they was there in the house when I was mar
ried.
Q. Any one else besides your wife’s relatives? A. Well, sir; I couldn’t hardly say they was
. It seems like there was, to, but then I don’t remember who it was.
Q. Was there anybody in the office when you got out your marriage license besides the clerk a
nd yourself? A. I don’t remember whether there was or not. There was a man went with me by th
e name of Willard Smith but I can’t tell any more where he is than you can.
Q. Do you remember some of the men who signed your petition? A. Yes, sir.
Q. Are they living? A. Yes, sir; several of them are living.
Q. Have you made very careful search for your license?
A. Yes, sir; I sure have. I have searched for them at different times.
Q. Is Brunett your first wife? A. Yes, sir.
Q. Are you her first husband? A. Yes, sir.
Have you been living in the Cherokee Nation ever since you were married? A. Yes, sir; I bee
n living right there in the district ever since we were married.
The applicant is requested to introduce evidence as to his marriage.

There is inclosed a copy of the decision of the Commissioner to the Five Civilized Tribes, da
ted January 10, 1907, rejecting, among others, the application for your enrollment as a citiz
en by intermarriage of the Cherokee Nation. The Commissioner's decision has this day been fo
rwarded to the Secretary of the Interior for review. You will be advised of the Secretary’
s action as soon as this office is informed of same. Respectfully, ___ Commissioner.
